This agreement is made and entered into by William Coker (Breeder) and....
for the purpose of setting forth the terms and conditions of the purchase of a
Please add date the birthdate of puppy
In order to reserve a puppy, the Purchaser agrees to pay a non-refundable deposit in the amount of $250. This deposit is non-refundable but is transferable up until the purchaser takes ownership of the puppy. There are no exceptions to this policy.
The Purchaser agrees to provide a life-long commitment, comfortable environment, prompt medical attention, proper grooming, and responsible care. This includes keeping the puppy parasite free and up to date on all inoculations. The Purchaser promises to provide a safe environment for the puppy, and never allow the dog to roam freely without the proper fencing or supervision. The purchaser agrees not to chain or tether the puppy/dog.
The Breeder guarantees this puppy to be of sound health and temperament at the time of sale. A health record of all vaccinations and wormings will be provided by the Breeder, along with a health statement from our veterinarian. The Purchaser agrees to take the puppy to a licensed veterinarian of his/her choice within 72 hours for a physical examination. Should the puppy be determined to be in ill health, the case of which is clearly attributed to the Breeder, the puppy may, upon signed written diagnosis from said veterinarian, be returned, at the Purchasers’ expense, for a refund of the purchase price. Purchaser must contact the Breeder within 24 hours of the veterinarian signed diagnosis and submit said diagnosis along with all records of care to the Breeder for review. Many conditions may arise due to the stress of travel that we cannot guarantee against and are not liable for such as Coccidia, Giardia, Diarrhea, Loss of Appetite, Vomiting, Hypoglycemia, among many others. Breeder also does not guarantee against any internal or external parasites. Breeder is not responsible for any veterinarian examinations, medicines, labs, tests, or diagnostics without prior written approval from the Breeder. In the unfortunate event the puppy dies, either during shipment or within the first 72 hours after the purchase, the puppy must be returned to the Breeder at the expense of the Purchaser so that we can have a necropsy done to determine the cause of death. If the puppy is not returned, then their will be no refund given. If the cause of death is determined that the Breeder is at fault, a full refund of the purchase price will be issued.
This puppy is being sold as a quality Working Dog. The Purchaser agrees to never breed this puppy, intentionally or unintentionally, and agrees to have it spayed/neutered at the age recommended by their veterinarian (usually 6 months to a year of age.) If the Purchaser wishes to breed said puppy, the breeder must be notified. The purchaser must obtain written approval from the breeder in order to breed said puppy.
The Breeder warrants the puppy against any genetic defects including but not limited to crippling hip dysplasia up until the age of 1 year. To satisfy the hip dysplasia warranty, radiographs must be sent to the Orthopedic Foundation of Animals for evaluation with a copy of the findings sent to the Breeder. The Breeder will replace the puppy with a quality puppy when available if the OFA ratings show crippling hip dysplasia, in which case the original puppy must be returned to the Breeder. If the Purchaser wishes to keep the puppy but wants another one, the Breeder will give the option to the Purchaser to buy another puppy at one-half of the purchase price. Purchaser must provide proof that the original puppy was spayed/neutered within the timeframe recommended by their veterinarian.
The Breeder will not be responsible for any travel/shipping expenses, either for receiving a puppy, sending back a puppy for a necropsy, returning an unhealthy puppy, or receiving a replacement puppy. We will not be responsible for any veterinarian expenses or diagnostic testing for any reason.
If at anytime the Purchaser can no longer retain possession of this puppy, the Breeder is to be notified and given first option of resuming full ownership of the puppy/dog in order for the Breeder to place this puppy/dog in a new home. The puppy will be returned with all medical records. Under no circumstances will this puppy be sold, leased, traded, or given away to any pet shop, research laboratory, animal shelter, or the like.
For the proper health of this puppy/dog, the Breeder agrees to extend the health guarantee from the original 1 year limit to 3 years, if the Purchaser strictly feeds TLC puppy/dog food. We feel that proper nutrition can help a puppy/dog remain strong and healthy. A link for this food can always be obtained on our website: EndlessSummersPuppies.com. An account must be set up with TLC in order to be able to show proof that the food was purchased and fed in order to enact the 3 year guarantee.
Remember, puppies are like children and can get sick very easy. We recommend that until your puppy has received all vaccinations to be considered fully vaccinated, they are not taken to public areas such as stores, dog parks, etc.
If the Purchaser doesn’t adhere to the timeframes set forth in this Agreement, the contract shall become void.
